NodePointer SDK
Terms of Service

These Terms govern your enabling and use of the NodePointer SDK inside a third-party application that hosts it. They apply to you as a user of that Host Application — not to the application's developer, who contracts with us separately.

These NodePointer SDK Terms of Service (“Terms”) govern your enabling and use of NodePointer SDK on a third party application hosting NodePointer SDK (“Host Application”). By enabling NodePointer SDK on Host Application, you (“User” or “you”) agree to enter into a legally binding agreement with NodePointer.com (“NodePointer”, “we” or “us”) and agree to install NodePointer SDK on your device.

By enabling NodePointer SDK on a Host Application, you also confirm that you have read and agree to be legally bound by our Privacy Policy.

If you do not agree with the Terms or our Privacy Policy and do not want it to apply to you – you should refrain from enabling NodePointer SDK on your device.

You may not enable NodePointer SDK and accept the Terms if a) you are not of legal age in your country b) you are prohibited from enabling NodePointer SDK under applicable laws, c) You are prohibited from entering into agreements similar to these Terms pursuant to your existing legal obligations with your internet service provider, mobile service provider, etc, d) You are enabling NodePointer SDK for competitive purposes (e.g., monitoring availability, performance, or functionality).

01NodePointer SDK

By installing the NodePointer SDK, you become part of NodePointer’s user network and agree to share your internet traffic with NodePointer and its clients. These clients remain anonymous to you, just as you remain anonymous to them. Your shared traffic may be used by various businesses for purposes such as verifying advertisements (potentially leading to seeing specific ads), gathering web data (possibly resulting in more captchas), or even accessing or providing streaming services. If you use a streaming platform and a client uses your device to access it, there’s a small chance you might temporarily lose access.

While NodePointer tries to prevent negative impacts to you, you are responsible for your ability to share your internet and for complying with local laws and agreements with other parties. Furthermore, installing the NodePointer SDK and agreeing to the Terms means you understand and accept these potential uses of your shared traffic.

NodePointer reserves the right to change, temporarily stop, or permanently end the NodePointer SDK or any connected service at any time, with or without notice and without any liability.

02Compatibility with Internet Provider Services

Your use of the NodePointer SDK may be charged by some internet providers for data and related services. NodePointer will not be responsible for any traffic-related or other costs from your service providers due to your agreements with them. Your provider might also restrict or ban apps similar to NodePointer SDK, and it may not be compatible with all their rules, so you should confirm its usability with them before enabling NodePointer SDK.

03Termination and Modification

We may terminate these Terms or your use of NodePointer SDK at any time for any reason, including but not limited to actual or alleged violations of these Terms. NodePointer shall not be liable to you or any third-party for any termination of your access to NodePointer SDK.

You may terminate these Terms by deleting the Host Application and all copies thereof from your device.

We reserve the right to modify, suspend or discontinue NodePointer SDK with or without notice and without liability to you.

04Limitation of Liability

UNDER NO CIRCUMSTANCES WILL EITHER PARTY BE HELD LIABLE TO THE OTHER OR ANY THIRD PARTY FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, REGARDLESS OF THE CAUSE OR THE LEGAL BASIS FOR THE CLAIM (INCLUDING NEGLIGENCE). THIS LIMITATION APPLIES EVEN IF A LIMITED REMEDY FAILS TO ACHIEVE ITS MAIN PURPOSE. NODEPOINTER’S OVERALL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL BE CAPPED AT $200 OR THE MAXIMUM EXTENT PERMITTED BY THE RELEVANT LAWS.

05Other Provisions

If any part of these Terms is deemed unenforceable or invalid, it will be modified to achieve its purpose as much as legally possible, while the rest of these Terms remain in effect.

We can update these Terms by posting the new version on our website and informing you. These updates will be effective 14 days after the notice. If you disagree with any changes, your option is to stop using the NodePointer SDK by disabling it in the Host Application and deleting the Host Application from your device. Continuing to use the Host Application with the NodePointer SDK enabled after this 14-day period means you accept the updated Terms.

If we don’t act on a right or part of these Terms, it doesn’t mean we waive the right to do so at any other point. If any part of these Terms is found to be illegal, void, or unenforceable, that part will be removed without impacting the rest of the Terms.

You are not allowed to resell, assign, or transfer your rights under these Terms. Attempting to do so may lead to termination without any obligation on our part. However, we can assign these Terms to a related company at any time with reasonable prior notice.

This Privacy Policy (“Policy”) explains how NodePointer.com (“NodePointer,” “we,” “us,” or “our”) collects, uses, discloses, and stores personal information of the users when they enable and use the NodePointer SDK on a third-party application hosting NodePointer SDK (“Host Application”). 01Data we collect

When you use a Host Application that incorporates the NodePointer SDK, we may collect and process specific categories of your personal data to enable and optimize SDK functionality, ensure service integrity, and enhance your experience. The categories of data we may access include:

  • Registration data: Information you provide to access SDK-related features, such as your email address and encrypted password.
  • Device information: Technical information about the device on which the Host Application is installed, including your IP address, operating system version, device model, last active timestamp, and static location (city and country).
  • Aggregated usage statistics: Data related to your interaction with the Host Application and the SDK, such as application usage analytics, crash reports, and error diagnostics. These may be gathered through integrated analytics platforms (e.g., Google Analytics, Meta Analytics), and are used solely to analyze performance and improve service quality.
  • Host application identification: Metadata specifying which Partner or Host Application is utilizing the NodePointer SDK on your device. This allows us to contextualize SDK activity and associate it with the appropriate Host Application.
  • Network and connectivity information: Basic information regarding the status of your network connection, such as whether your Wi-Fi is enabled. This is necessary for facilitating SDK operations that depend on network availability.
  • Communication and contact data: If you initiate contact with us via email or through our support channels, we collect details such as your email address, name (if provided), the subject and content of your message, attachments, and our response. This data is processed solely for the purpose of managing and responding to your inquiry effectively.

Protection of children’s data

We do not knowingly collect or process personal data of children under the age of 14, or any age that would require parental or guardian consent under applicable data protection laws. The NodePointer SDK is not intended for, nor directed at, minors. If we become aware that we have inadvertently collected data from a child without proper authorization, we will take immediate steps to delete such information. If you are a parent or legal guardian and believe that your child has provided us with personal information without your consent, please contact us promptly. We will take the necessary actions to stop processing the child’s data and erase any information already collected.

02Purposes for data collection

The personal data outlined in Section 1 is processed for the following purposes, in alignment with the functionality of the NodePointer SDK and the services provided through Host Applications:

  • Provision of NodePointer SDK services: to deliver and maintain the core features of the NodePointer SDK, including enabling SDK functionality within Host Applications, facilitating technical integration, and communication with you regarding service availability.
  • Service maintenance, optimization, and security: to ensure the reliability, efficiency, and safety of our services, including monitoring and analyzing usage data to enhance performance; identifying and addressing technical issues (e.g., bugs, crashes); detecting, investigating, and preventing fraud, abuse, and security threats; verifying user email addresses for authentication purposes; safeguarding infrastructure to prevent unauthorized access.
  • Compliance with legal and regulatory obligations: to fulfill our obligations under applicable laws and regulations, including adhering to data access, record-keeping, and tax reporting requirements; enforcing the NodePointer SDK Terms of Service; exercising and defending our legal rights in disputes or regulatory proceedings.
  • Marketing and promotional activities: to inform users about services, special offers, including sending marketing communications where permissible. You may opt out of marketing communications at any time.

03Legal basis for data processing

We process your personal data under the following legal grounds:

  • Performance of a contract: We process your personal data when it is necessary for the performance of a contract between you and NodePointer, specifically, the delivery of SDK functionality within a Host Application, including user onboarding, related support services.
  • Legitimate interests: We rely on our legitimate interests to process personal data in ways that are essential to the operation and improvement of our services. These include: enhancing user experience and application functionality; maintaining service integrity and platform security; managing user communications and inquiries; promoting our services through non-intrusive marketing.
  • Consent: in certain cases, such as sending direct marketing communications, we process your personal data based on your consent. You may withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

04Data retention

We retain your personal data only as long as necessary for the purposes outlined in this Policy. If the data is no longer required for a purpose pursued by us and there are no legal obligations to retain it (e.g., tax retention periods to which we are subject), we delete personal data. We only store personal data to the extent that it is necessary to comply with our legal obligations, particularly statutory retention periods, and for the establishment, exercise, or defense of legal claims. 07No automated individual decision-making, including profiling

We do not make decisions based solely on automated processing, including profiling, which would produce legal effects concerning you. However, for security purposes, we use algorithms to decide whether there are any abnormalities in our user base. In case the algorithms show such abnormalities, the related activities are submitted for a human review and may result in suspension or (in the most extreme cases) termination of our services.
